Terms and Conditions

A summary of Terms and Conditions for Pakistan, Europe, Africa, Middle East, USA, Canada, Australia and New Zealand is detailed on the following pages.

General
1) Terms and Conditions are correct at time of going to press but are subject to change.
2) Terms and Conditions vary by country. The Hirer should check at time of reservation and note that all rentals are subject to the Terms and Conditions on display at Avis offices or when applicable as detailed on the reverse of the Rental Agreement.
3) All insurances may be subject to a non-waivable excess.
4) Hirer must have held a valid national driving licence for at least one year. An International Licence may also be required. Hirer must meet Avis age, driver and credit requirements.
5) The minimum age is 21-25 (23-25 for additional drivers) depending on country of rental. Check with Avis Reservations when booking
6) Hirer will be provided with a full tank of fuel. If hirer returns the car with a full tank, no refuelling charges will apply. However, if Avis is required to refuel the tank after hirer has returned the vehicle a charge will be levied which takes into account the cost of the fuel, time and labour incurred in refuelling the vehicle.
7) Avis reserves the right to refuse to rent. All rentals are subject to the full Avis Terms and Conditions, which are on display at Avis offices or when applicable detailed on the back of the Rental Agreement and Insurance Policy Document and should be read at the time of rental.
8) Airport service charge: Rentals commencing at airport locations may be subject to a surcharge. Please check at time of booking.
9) ) One way rentals are often available; fees may apply, check at time of booking.
10) Rental period: Daily rates are based on 12 or 24 hour periods as specified.

Pakistan

1) Avis will let and the Hirer will take on hire the vehicle upon the following terms and conditions:
a) The Hirer shall be the mere bailee of the vehicle and no interest in it shall be passed to the Hirer.
b) The person driving the vehicle must possess a valid driving license.
c) Any traffic offences/violations of prevailing country laws shall be the responsibility of the hirer.
d) Vehicle(s) provided shall have manual transmission.
e) Vehicle(s) provided will have tracking system installed.
2) The hiring shall commence on the date and at the time specified in the rental agreement and shall continue for the period and end on the date and the time therein stated, irrespective of whether the vehicle is in use by the Hirer or not.
3) The Hirer shall pay all amounts of rental in respect of each vehicle as calculated by Avis, including all traffic fines, fees, toll taxes, etc.
4) The Hirer agrees as follows:
a) to punctually pay all amounts of rental payable
b) that in no event shall the rental or other charges and payments hereunder be subject to any deduction or set-off by the Hirer, unless as specified by Income tax laws or other applicable local laws in which event due certificates will be provided.
c) Hirer is responsible for maintaining proper oil, coolant, water etc. level.
d) To cause the vehicle to be operated with all proper care and diligence and within the laws of the land and to use all proper precautions to prevent loss or damage to the vehicle or injury to third parties.
e) That the Hirer will not lend, let on hire, sell, assign, transfer, charge, dispose of, or part with the control of the vehicle (s) or attempt to do so.
f) That the Hirer shall report any accident involving the vehicle to Avis as well as the insurers concerned immediately on the occurrence of the accident and also to the Police and other proper authorities within the time prescribed by law. The Hirer shall supply such information and assistance in connection with the accident as Avis or its insurers may require.
g) The Hirer shall not without the prior consent of Avis give any instructions for any repairs to the vehicle or for the replacement of any part thereof rendered necessary by breakdown, accident, or normal wear and tear.
h) In the event of the vehicle (s) being adjudged by both the parties on mutual consent as a total loss or irrecoverable or adjudged by the insurance company that the claim for such vehicle is not payable due to any act of malfeasance or misfeasance by the Hirer, then Hirer will reimburse (after allowance to the Hirer of any money received by Avis by virtue of the said insurance) Avis the fair market value of the vehicle. The rental charges thereunder shall continue to be payable until such time as Avis has received the full amount due
5) The Hirer expressly acknowledges personal liability and to pay Avis on demand:
a) All fines and court costs for parking, traffic or other legal violations assessed against said vehicle during term of hire, except where caused through fault of Avis
b) On the confiscation of the hired vehicle due to the fault of Hirer by any Government/civil body, the Hirer shall indemnify Avis for all losses incurred up to and including the value of the vehicle.
6) The Hirer hereby releases Avis from any liability for persons transported and loss of or damage to any property left, stored or transported by Hirer or any other person in or upon the vehicle (s) before or during the term of this hire or after return of the vehicle (s) to Avis. Hirer further agrees to hold Avis harmless from and to defend and indemnify Avis against all claims and costs based upon or arising out of such loss or damage.
7) Avis shall not be liable for mechanical failure of hired vehicle or consequential damages. The Hirer shall not make any claim for damages for delay through break down or accident.
8) If the Hirer shall during the continuance in force of the period of hire fail to pay any rental or any charge payable hereunder immediately when due whether previously demanded or not or fail to observe or perform any of the conditions contained in this agreement on its part to be observed and performed, then and in every such case, Avis may (without prejudice to any other rights Avis may have) terminate the hire and thereupon Avis may forthwith resume possession of the vehicle and for such purpose, the Hirer authorizes Avis, his servants or agents without further notice to enter into and upon any premises in which the vehicle may be and thereupon repossess the same without being liable to any action or proceedings at the suit of the Hirer or any person claiming under or through it.
9) On the termination of this Agreement by Avis, or abandonment or invalid termination by the Hirer, Avis may at his sole discretion and in addition to any other remedy available to him take legal action for the recovery of the total amounts due and without notice to the Hirer and to take possession of any or all the vehicles wherever the same may be located, without any court order or other process of law, without derogation from its rights to take appropriate action through court or under due process of law. The Hirer hereby waives any and all damages occasioned by such taking of possession. Any said taking of possession shall not constitute a termination of the terms of hire as to the vehicle unless Avis so notifies the Hirer in writing.
10) The Hirer agrees to indemnify Avis against all actions, claims, demands, proceedings, costs or expenses, damage and liabilities whatsoever arising in respect of or out of the use of the vehicle or in consequence of the hire
11) It is hereby agreed that if for any reason Avis deems it impracticable or inexpedient to repair the vehicle Avis shall have the right to replace the vehicle with an alternative vehicle of similar seating capacity and performance within a period of two-three weeks and will provide a back-up car, of same features, during the period of time the necessary permanent arrangement is being made.
12) No forbearance, indulgence or relaxation on the part of Avis shown or granted to the Hirer in enforcing any of the terms or conditions of the terms of hire shall in any way diminish, restrict or prejudice the right or powers of Avis or operate as or be deemed to be a waiver of any breach of the terms and conditions of the hire on the part of the Hirer
13) Avis shall be bound only by the provisions of the terms of hire notwithstanding any proposal, representation or arrangement that may have been made or suggested either before or at the signing hereof by any person whatsoever or in any advertisement or advertising matter or otherwise and no vitiation of the terms or conditions of the term of hire shall be binding on Avis without its previous consent in writing
14) These terms of hire shall become binding on the Hirer upon acceptance by signature on its part and shall be deemed to be made on the date on which it is so signed
15) In the terms of hire, the vehicle (s) includes all replacements and renewals thereof and all accessories and additions thereto whether made before or after the date of hire
16) All rights of Avis may be assigned, pledged, mortgaged, charged, transferred or otherwise disposed of either in entirety or in parts, without any notice to the Hirer.
17) The Hirer shall not, without the prior written consent of Avis;
a) Assign, transfer, pledge or hypothecate the vehicle (s) or any part thereof or any interest there against, or
b) Part with possession or deliver physical or constructive possession of the vehicle (s) or any part thereof to any third parties whatsoever under any arrangements whatsoever
18) Any notice required or permitted to be given to the Hirer hereunder shall be deemed validly given if served on the Hirer personally or if sent by recorded post to the last known address of the Hirer. Any such notice sent by recorded post shall be deemed to have been received by the Hirer.
19) That additions to or alterations of the terms and conditions of hire shall be null and void unless agreed upon in writing.
20) This agreement shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan.
21) In the event of any dispute between the parties hereto arising out of or in relation to this agreement, the dispute shall be referred in two arbitrators, one to be appointed by each party. The arbitration shall be under the arbitration Act 1940 and the venue of arbitration shall be Islamabad.

Europe, Africa, Middle East and Asia

SuperValue rate includes: Unlimited mileage/kilometers, Statutory Third Party Liability, Collision Damage Waiver (a non-waivable excess may apply in some areas), Theft Protection and local taxes

SuperValue rate does not include Optional insurances, fuel, airport surcharges (if applicable), non-waivable excess fee (if applicable), one way rental fees, additional driver fees, and vehicle registration fee.

Collision Damage Waiver (CDW). CDW is designed for accidental damage caused to the Avis vehicle other than by theft or attempted theft and includes the cost of repairing or replacing the vehicle, towing, storage charges, loss of use and administrative costs. There is a policy excess responsible to the Hirer. CDW is mandatory if the Hirer is aged between 23-25 and paying by cash or cheque. If CDW is declined, the Hirer will be their own insurer. If the vehicle gets damaged and there is no CDW cover, the Hirer will be responsible for the cost of repair of damages up to the replacement value of the car.

Theft Protection (TP) Provides cover for the theft or attempted theft of the vehicle up to the full value of the vehicle and any additional costs.

Personal Accident Insurance (PAI) PAI provides the Hirer and passengers traveling with the named driver with a specified amount of accidental death insurance and medical coverage for injuries due to an accident while in the Avis vehicle. In some countries PAI also covers baggage.

Super Collision Damage Waiver (SCDW), Super Theft Protection (STP) and Super Personal Accident Insurance (SPAI) These insurance options are available at a higher premium in a number of countries and provide increased coverage.

USA and Canada

USA
Your USA SuperValue rate includes:
SuperValue rate does not include:State/local taxes (tax varies by state between approximately 4% and 18%), state surcharges, optional coverage, fuel, one way rental fees where applicable, airport contract fees, charges for additional drivers and drivers aged between 21-25 years.


Canada

Your USA SuperValue rate includes:
Unlimited mileage, Loss Damage Waiver (LDW)
SuperValue rate does not include:Local taxes, optional coverage’s, fuel, one way rental fees (where applicable) and additional driver fee, excess kilometres.

Minimum age limit: 21-25 years, varies by location.


USA and Canada insurances: Loss Damage Waiver LDW is not available from Avis in Illinois or New York. In the state of New York, you are liable to pay up to US$100 towards damage to the Avis vehicle and in Illinois up to US$200.

If you do not accept LDW, you are responsible for all loss of or damage to the rental car due to theft, collision, vandalism, or any cause other than specified on your Rental Agreement.

If you do not accept LDW, you are responsible for all loss of or damage to the rental car due to theft, collision, vandalism, or any cause other than specified on your Rental Agreement.

Laws may also prohibit Avis from offering it in other areas of the U.S. If local law, where your Rental Agreement is signed, provides LDW terms that are different than those stated in your Rental Agreement, local law will apply.


Additional Liability Insurance

ALI insures you and authorised operators as defined in the Avis Rental Agreement against claims made by third parties against you, the customer, for bodily injury/death and property damage caused by the use or operation of an Avis Rental Vehicle. The purchase of ALI is not required in order to rent an Avis car. In Canada, Public Liability and Property Damage vary by Province and are included in the rates with a maximum of CA $200,000 per accident (CA $50,000 in the province of Quebec).


Personal Accident Insurance (PAI) (USA)

PAI provides the Hirer and passengers traveling with the named driver with a specified amount of accidental death insurance and medical coverage for injuries due to an accident while in the Avis vehicle. In some countries PAI also covers baggage.

Personal Effects Protection (PEP)

PEP insures against all risks of physical loss or damage to the insured property from any external cause, except as excluded, during the rental period of the vehicle.

The maximum coverage for each covered individual during the rental period is US $600 (US $500 in New York) and CA $500 in Canada, after a deductible of US $25 / CA $50 per covered claim. The maximum coverage for all individuals during the rental period is $1,800 in the U.S. ($1,500 in New York and Canada) after application of all deductibles.


Coverage is provided for:

A. The person signing the Rental Agreement (Hirer), and

B. Members of the immediate family traveling with the Hirer, and who are permanently residing in the same household.

Avis reserves the right to amend prices should the USA impose insurance legislation or make changes to US State or local laws during the validity of this brochure.


Australia and New Zealand


AUSTRALIA

SuperValue rate includes:

Unlimited kilometers in metropolitan areas; Statutory Third Party Liability; Loss Damage Waiver; Goods and Services Tax (10%); State Stamp Duty

SuperValue rate does not include

Excess kilometers in remote areas, Personal Accident Insurance, Personal Effects and Baggage Insurance, one way fee, fuel, excess fees if applicable, Airport concession recovery fees, optional extras

One way rentals:

One way rentals in Australia are available on a request basis and are subject to the one way rental policy current at time of rental.

What you should know about insurance

Your liability and insurance:

In the event of accidental damage all rentals are subject to an excess of up to A$2750. An additional insurance may be available locally to cover any excess

Kilometres:

Unlimited in Northern Territory, Metropolitan and country areas. In other areas, rates include 100kms per day, excess charged at 27c per kilometer.

Personal Accident Insurance (PAI)

PAI provides the Hirer and passengers traveling with the named driver with a specified amount of accidental death insurance and medical coverage for injuries due to an accident while in the Avis vehicle. In some countries PAI also covers baggage.

Loss Damage Waiver (LDW)

LDW is designed for accidental damage caused to the Avis vehicle other than by theft or attempted theft and includes the cost of repairing or replacing the vehicle, towing, storage charges, loss of use and administrative costs. Vehicles rented from mainland Australia may not leave the mainland. Other restrictions apply, refer to reservation centre for details.


NEW ZEALAND

SupreValue rate includes:

Unlimited kilometers, Motor Vehicle Insurance

SupreValue rate does not include:

Goods and Services Tax (GST), delivery fees, miscellaneous charges, petrol and GST on these charges. One way rentals: Vehicles cannot be picked up in one island and left in another. When travelling between islands, change-over vehicles are supplied in Wellington (WL4) in the North Island and Picton (PN6) in the South Island. This change-over service will be calculated as one continuous hire, providing the next vehicle is picked up within 5 hours. 72 hours notice is required for the change-over service and a minimum hire period of 3 days in each island applies.


What you should know about insurance

Your liability and insurance:

In the event of accidental damage all rentals are subject to an excess of up to NZ$1500 plus GST.

Country Locations

Remote location surcharge of NZ$5.00 plus GST is applicable to rentals commencing at these locations: Greymouth, Hokitika, Westport, Gisborne.

Insurance Excess

In the case of damage to the vehicle the Hirer is liable for an insurance excess. The amount of the excess is NZ$1200 plus GST for car groups A-E & NZ$1500 plus GST for car groups P-V. An additional insurance may be available locally to cover any excess. Refer to reservation centre for details.

Personal Accident Insurance (PAI)

PAI provides the Hirer and passengers traveling with the named driver with a specified amount of accidental death insurance and medical coverage for injuries due to an accident while in the Avis vehicle. In some countries PAI also covers baggage.

Motor Vehicle Insurance (MVI)

MVI protects liability against damage to the Avis vehicle, salvage charges, legal fees, damage to the third party property and Avis loss of use.
